Terms of Use

Menufly is provided by Klemen Hrastnik, an individual based in Slovenia. References to "Menufly," "we," "us," or "our" in these Terms refer to Klemen Hrastnik acting in this individual capacity.

By creating an account, accessing, or using Menufly ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. If you are using the Service on behalf of a restaurant, bar, café, or other business, you confirm that you are authorised to accept these Terms on that business's behalf.

Menufly is a digital, QR-code-based menu platform that allows restaurants, bars, cafés, and similar venues ("Venues") to create, manage, and share digital menus with their guests. The Service currently includes:

• Menu, category, and dish management
• QR code generation for menu access
• Basic visit and engagement analytics
• Optional guest reviews
• Multi-language menu support

Features may be added, changed, or removed over time as the Service develops. Where a feature is limited to a paid plan, this will be clearly indicated within the Service.

• You must provide accurate information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must notify us promptly at info@menufly.si if you suspect unauthorised use of your account.
• You must be legally able to enter into a binding contract to use the Service.

You retain ownership of the content you upload to Menufly, including menu items, descriptions, prices, images, and restaurant information ("Your Content"). By uploading Your Content, you grant Menufly a limited licence to host, store, display, and transmit it solely for the purpose of operating and providing the Service to you and your guests.

You are responsible for ensuring that Your Content:

• Is accurate (including prices, allergen, and ingredient information — see Section 6)
• Does not infringe the rights of any third party
• Complies with applicable law

Menufly is a publishing tool. We do not verify the accuracy of allergen, ingredient, nutritional, or pricing information entered by Venues. Venue owners are solely responsible for the accuracy of this information. Guests should always confirm allergen and ingredient details directly with venue staff before ordering, particularly in the case of severe allergies. Menufly accepts no liability for inaccuracies in Venue-provided content.

Menufly is currently offered free of charge, and no payment processing takes place through the Service at this time.

You may optionally join a waitlist to be notified when a paid "Pro" plan becomes available. Joining the waitlist:

• Only requires and stores your email address for the sole purpose of sending you a notification if and when a paid plan launches
• Does not create any payment obligation, subscription, or contract for future payment
• Does not guarantee a paid plan will launch, or launch on any particular timeline

Before any paid plan is introduced:

• Pricing and features will be clearly disclosed before you are asked to pay
• No payment will be taken without your explicit action
• These Terms will be updated to reflect billing, cancellation, refund terms, and the identity of the entity processing payment (which may differ from the individual operator described in Section 1, if a registered business is established beforehand) prior to any paid plan becoming available

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that is fraudulent, defamatory, obscene, or infringing
• Attempt to access other users' accounts or data without authorisation
• Interfere with or disrupt the operation of the Service
• Reverse-engineer, scrape, or resell the Service without our written permission

We may suspend or terminate accounts that violate these terms.

Where guests submit reviews or interact with public menus, this data is processed as described in our Privacy Policy. Guest-facing menu pages are publicly accessible via QR code or direct link by design — this is a core function of the Service.

We aim to keep the Service available and reliable but do not guarantee uninterrupted access. As an individually operated, actively developed product, features, layout, and pricing structure may change. We will make reasonable efforts to communicate material changes affecting paid features in advance.

The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, Klemen Hrastnik shall not be liable for indirect, incidental, or consequential damages arising from use of the Service, including loss of business, revenue, or data. Nothing in these Terms limits liability that cannot be excluded under applicable law.

Personal data is processed in accordance with our Privacy Policy and applicable data protection law, including the GDPR. For any data protection inquiries, contact info@menufly.si.

You may stop using the Service and delete your account at any time. We may suspend or terminate access to the Service for violations of these Terms, with notice where reasonably possible.

These Terms may be updated from time to time as the Service evolves. Material changes will be communicated via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Republic of Slovenia, without regard to conflict-of-law principles, to the extent permitted by applicable consumer protection law in your jurisdiction.
